1. Purpose and Scope
These New Jersey Specific Terms (“Jurisdiction Terms”) to the Terms of Use (“Terms of Use”) describes the New Jersey specific terms applicable to Penn Sports Interactive, LLC’s (“PSI”) provision of its Services, ESPN BET and Hollywood Casino, to you within the State of New Jersey. The use of the Services in New Jersey is subject to all applicable federal laws and regulations of the United States of America, the applicable laws and regulations of the State of New Jersey, the Governing Documents and these Jurisdiction Terms. The State Gaming Authorities authorizing the Services in the State of New Jersey are the New Jersey Division of Gaming Enforcement (“NJDGE”). All capitalized terms used herein but not defined shall have the meaning ascribed to them in the Terms of Use.
2. Responsible Gaming & Excluded Persons

Individuals may choose to set responsible gaming limits, suspend their Account for no less than seventy-two (72) hours and no more than one (1) year, or exclude themselves from establishing or maintaining an Account on the Services. To request registration on the NJDGE’s self-exclusion list, an individual must submit an application either in person with the NJDGE or apply for registration on the NJDGE’s website or on the Services (as applicable). A person who has enrolled in self-exclusion or has otherwise been excluded from Interactive Gaming activities and individuals who are under the age of 21 shall not participate in Interactive Gaming or Interactive Gaming activities and will have their winnings forfeited and Accounts suspended upon violation.

If you enroll in self-exclusion from all wagering, your Account will remain deactivated unless you contact us by telephone to request the reactivation of your Account after you are removed from the interactive gaming self-exclusion list. No other method of contact will re-activate your Account and we reserve the right to deny a reactivation request for any reason. Once we receive your initial reactivation request, there will be a 24-hour waiting period during which our compliance and operations team will confirm you are no longer excluded from wagering. After the 24-hours has passed, you will be contacted with the results of the review and will be informed as to whether your Account will be reactivated or not.
Enrolling in self-exclusion may also result in your exclusion from other forms of interactive gaming, any casino or racetrack facility now or in the future operated by, and/or any other products or services now or in the future offered by us (including affiliates), regardless of location. As stated in Section 6(d) of the Terms of Use, Excluded Persons are not permitted to establish an Account or use the Service. For New Jersey, Excluded Persons are defined as follow:
- The Governor or Lieutenant Governor of New Jersey;
- Any New Jersey state officer or employee or special state officer or employee as defined in the Casino Conflicts of Interest Law;
- Any member of the New Jersey judiciary;
- Any member of the New Jersey legislature;
- Any officer of Atlantic City;
- Any person employed as a casino key employee;
- Any person living in the same household as any director, officer or owner of PSI; and
- Any person prohibited from gaming pursuant to N.J.A.C. 13:69G, N.J.S.A. 5:12-119, or N.J.S.A. 5:12-100n.
3. Underage Gambling & Prohibited Participants
In New Jersey, in addition to those listed in Section 6(f) of the Terms of Use, Prohibited Participant also includes a person identified by any lists provided by the sport governing body to the NJDGE, shall not be permitted to wager on any event governed by the league or sport governing body with which they are affiliated. Any employee of a sport governing body, or one of its member teams, who is not prohibited from wagering as described herein shall register with the NJDGE prior to placing a wager.
By offering to place a wager with PSI, and as a condition of PSI accepting your wager, you represent and warrant, that you are not a “prohibited sports wagering participant” as defined under N.J.A.C 13:69N-1.1 or the direct or indirect legal or beneficial owner of 10 percent or more of a sports governing body or any of its member teams affiliated with the wager.
In New Jersey, it is a criminal offense to allow a person who is under twenty-one (21) years of age to participate in Internet or mobile gambling. PSI takes its age-verification responsibility very seriously. PSI carries out age-verification checks on all customers at the time of Account creation. PSI will ask for information to verify your age and identity (including requesting a copy of a government issued identification) and can restrict or suspend your Account until your age and identity are confirmed. By signing up for an Account, you consent to PSI’s confirmation of your age and identity. Please note that anyone under the permitted age for participating in Internet or mobile gambling found to be using the Services may be reported to law enforcement and be subject to other legal penalties.
4. Geographic Scope of Agreement: No Use Outside the New Jersey
Online sports wagering and Internet gaming offered as part of the Services are operated and controlled by PSI (i) under an agreement with DGMB Casino, LLC, d/b/a Resorts Casino Hotel (“Resorts Casino Hotel”), which holds an internet gaming permit issued by the NJDGE, and (ii) pursuant to the oversight, regulatory requirements, and licensing of the NJDGE.
PSI is further approved by the NJDGE as an internet sports pool operator and internet gaming affiliated operator of Resorts Casino Hotel and holds a casino service industry enterprise license, sports wagering permit and internet gaming permit each of which was issued by the NJDGE.

6. Dormant Accounts
In New Jersey, Accounts are deemed “dormant” if the user has not logged in to the System within any Permitted Jurisdiction during a twelve (12) month period. Dormant Accounts will be opted out of all bonuses in accordance with the Special Rules. In accordance with applicable laws and regulations, unclaimed balances in dormant Accounts may be forfeited.
7. New Jersey Prohibited Wagers
The wagers on the following events are prohibited in New Jersey (each a “NJ Prohibited Event”):
- Any collegiate sport or athletic event that takes place in New Jersey, or a sport or athletic event in which any New Jersey college team participates regardless of where the event takes place; and
- All high school sports events, electronic sports, and competitive video games.
An NJ Prohibited Event does not include (a) the other games of a collegiate sport or athletic tournament in which a New Jersey college team participates, nor does it include any games of a collegiate tournament that occur outside New Jersey even though some of the individuals games or events are held in New Jersey; and (b) international sports events in which the majority of the participants are over the age of 18. Further, NJ Prohibited Events will not include events that are otherwise approved by the NJDGE.

10. Tax Reporting & Withholding
Your use of the Services is subject to compliance with applicable U.S. tax reporting and withholding laws as in effect from time-to-time. You acknowledge and agree that PSI must and is hereby authorized to report and/or withhold your winnings in accordance with U.S. tax reporting and withholding laws as in effect from time-to-time. All winnings subject to reporting and/or withholding may be reported and/or withheld by PSI and a copy of the W-2G Form (or such other form provided by the U.S. Internal Revenue Service for this purpose) summarizing the information may be issued by PSI for tax purposes no later than when required by applicable law. In the event of any technical, system or human error resulting in insufficient withholdings from any winnings, PSI may deduct the relevant outstanding amount from funds in your Account or recover the relevant outstanding amount from you through any other lawful means. You hereby irrevocably authorize PSI to file all required reports regarding your wagering activities with the U.S. Internal Revenue Service and any other applicable taxing authority. In addition to any withholding by us, you may be subject to additional income withholding requirements based on the applicable law in your state of residency. You are solely responsible for any taxes incurred in connection with winnings on the Services.
You agree to indemnify and hold harmless PSI and its affiliates for any claims, demands, liens, or judgments based on your non-payment or underpayment of such taxes. You hereby grant to PSI a priority lien and security interest in all of your right, title and interest in and to the proceeds of any wager to the extent required to satisfy any taxing authority’s claims or liens.
11. Network Disconnection
In the event that a network disconnection such as failure or disconnection of computer, telecommunication services, Internet or otherwise occurs during game play the following will apply: (i) where your input is not required to complete the game, the game shall produce the final outcome as determined by the random number generator and upon reconnection, the game outcome shall be reflected in the Account History; (ii) where your input is required to complete the game, the game shall not produce the final outcome and upon reconnection, you can return to the game state immediately prior to the disconnection to complete the game; and (iii) where the outset of a playing session is initiated within a permitted jurisdiction, but, at a later point in the playing session.
