1. Purpose and Scope
These Indiana Specific Terms (“Jurisdiction Terms”) to the Terms of Use (https://espnbet.com/legal/terms) (“Terms of Use”) describes the Indiana specific terms applicable to Penn Sports Interactive, LLC’s (“PSI”) provision of its Services, ESPN BET, to you within the State of Indiana. The use of the Services in Indiana is subject to all applicable federal laws and regulations of the United States of America, the applicable laws and regulations of the State of Indiana, the Governing Documents, and these Jurisdiction Terms. The State Gaming Authorities authorizing the Services in the State of Indiana are the Indiana Gaming Commission (“IGC”). All capitalized terms used herein but not defined shall have the meaning ascribed to them in the Terms of Use.
2. Responsible Gaming & Excluded Persons

Individuals may choose to set responsible gaming limits, suspend their Account for no less than seventy-two (72) hours and no more than one (1) year, or exclude themselves from establishing or maintaining an Account on the Services. To request placement on the Board’s Internet Self Restriction List, an individual may sign up via the Board’s website at www.in.gov/igc/ISRP. A person who has enrolled in the Internet Self Restriction List or has otherwise been excluded from Interactive Gaming activities and individuals who are under the age of 21 shall not participate in Interactive Gaming or Interactive Gaming activities and will have their winnings forfeited and Accounts suspended upon violation.

If you enroll in interactive gaming self-exclusion, which includes self-exclusion from interactive sports wagering, your Account will remain deactivated unless you contact us by telephone to request the reactivation of your Account after you are removed from the interactive gaming self-exclusion list. No other method of contact will re-activate your Account and we reserve the right to deny a reactivation request for any reason. Once we receive your initial reactivation request, there will be a 24 hour waiting period during which our compliance and operations team will confirm you are no longer excluded from gambling. After this 24 hours has passed, you will be contacted with the results of the review and will be informed as to whether your account will be reactivated or not.
Enrolling in interactive gaming self-exclusion may also result in your exclusion from interactive gaming, any casino or racetrack facility now or in the future operated by, and/or any other products or services now or in the future offered by us (including affiliates), regardless of location. As stated in Section 6(d) of the Terms of Use, Excluded Persons are not permitted to establish an Account or use the Service. Indiana, Excluded Persons are defined as follow:
- A member of the IGC;
- An employee of the IGC;
- An agent of the IGC;
- The spouse of any member, employee or agent of the IGC;
Except that a member, employee, or agent of the commission may participate in sports wagering if that person:
- has received the written authorized from the IGC’s executive director or the executive director’s designee to participate in sports wagering as part of the person’s employment; and
- is participating only to the extent authorized.
3. Underage Gambling & Prohibited Participants
In Indiana, in addition to those listed in Section 6(f) of the Terms of Use, Prohibited Participant also includes a person that is prohibited under IC 4-38, identified by any lists provided by the sport governing body to the IGC, shall not be permitted to wager on any event governed by the league or sport governing body with which they are affiliated. Any employee of a sport governing body, or one of its member teams, who is not prohibited from wagering as described herein shall register with the IGC prior to placing a wager. Prohibited Participants include:
- Any person under the age of twenty-one (21);
- Any person on a self-exclusion list or other exclusion list where individuals named therein are prohibited from playing in-person or interactive casino or pari-mutuel wagering or interactive sports wagering, including a prohibited person as defined by regulation;
- Any gaming employee, key employee or principal or similar individual required to obtain a license issued by the Board;
- Any employee, director, or officer of PSI prohibited under Company policy from engaging in any form of Interactive Gaming within ESPN BET;
- Any person identified as a prohibited sports wagering participant on a list submitted to the Board by a sports governing body and for whom PSI is prohibited from accepting wagers under applicable the Board’s regulations;
- Any public official, public employee or agent of the Board and any spouse or family member of the foregoing prohibited by law or regulation from Interactive Gaming in the Applicable U.S. States; and
- Any person who by virtue of the person’s affiliation or employment with another company operating in the sports gaming industry has access to that company’s pre-release, non-public, or confidential data or other information that is not available to all other Users that may provide you an advantage in any sports wagering.
In Indiana, a person who is under twenty-one (21) years of age is prohibited from participating in Internet or mobile gambling. PSI takes its age-verification responsibility very seriously. PSI carries out age-verification checks on all customers at the time of Account creation. PSI will ask for information to verify your age and identity (including requesting a copy of a government issued identification) and can restrict or suspend your Account until your age and identity are confirmed. By signing up for an Account, you consent to PSI’s confirmation of your age and identity. Please note that anyone under the permitted age for participating in Internet or mobile gambling found to be using the Services may be reported to law enforcement and be subject to other legal penalties.
By offering to place a wager with PSI, and as a condition of PSI accepting your wager, you represent and warrant, that you are not a “prohibited sports wagering participant” as defined in IC 4-38-9-3(5).
4. Geographic Scope of Agreement: No Use Outside the Indiana
In accordance with the scope of this Agreement (and any other state-specific terms of service agreement which you have agreed to), you acknowledge and agree that you will and must be physically present in person in the State of Indiana at all times while wagering on the Services (or in such other U.S. State or territory for which we or our applicable state-licensed affiliate may permit you to use the Services to engage in wagering pursuant to a separate state-specific terms of service agreement entered into with the applicable state-licensed affiliates of PSI). As used in this Agreement, “Applicable U.S. States” refers to the State of Indiana and such other U.S. States or territories in which we and our applicable state-licensed affiliates have permitted you to use the Services for wagering.

6. Dormant Accounts
In Indiana, Accounts are deemed “dormant” if the user has not logged in to the System within any Permitted Jurisdiction during a three (3) year period. Dormant Accounts will be opted out of all bonuses in accordance with the Special Rules. In accordance with applicable laws and regulations, unclaimed balances in dormant Accounts may be forfeited.
7. Indiana Prohibited Wagers
Wagers on the following events are prohibited in Indiana (each an “Indiana Prohibited Event”):
- Collegiate events that are not NCAA Division I sports (for college football, NCAA Division I includes both Football Bowl Subdivision and Football Championship Subdivision).
- In-play, collegiate player proposition wagers.
- In-play wagers for professional and collegiate sporting events that are not settled or completed at natural game, contest breaks, or at specified times and event in a game or match.
Indiana Prohibited Events will not include events that are otherwise approved by the IGC.

9. Indiana Approved Account Withdrawal Methods
All withdrawals of cash balances in your Account are paid out in U.S. dollars through such methods of withdrawal as may be authorized by us from time-to-time in our sole discretion, which may include the following:

- Digital Payment Vehicles;
- Withdrawal at Cage;
- ACH/Online Banking; and
- Such other options that may become available in the future at our sole discretion.
All withdrawals will be processed within approximately five (5) business days of the withdrawal request with the funds from your Account available as promptly as possible in accordance with the applicable withdrawal method; unless we believe, in good faith that you engaged in fraudulent conduct or conduct that puts us in violation of applicable law or regulation. Each withdrawal may be subject, in our sole discretion, to different (i) minimum and maximum withdrawal requirements, (ii) hold periods before the withdrawal is posted to your Account; and (iii) additional requirements. Such requirements and withdrawal instructions are available and kept current here or you can contact Customer Service. Bonus funds that have not been converted to cash in accordance with the applicable bonus and promotion terms may not be withdrawn from your Account. You acknowledge that these requirements and withdrawal instructions are subject to change from time-to-time without further notice to you and in our sole discretion and agree to abide by all posted requirements and instructions.

10. Tax Reporting & Withholding
Your use of the Services is subject to compliance with applicable U.S. tax reporting and withholding laws as in effect from time-to-time. You acknowledge and agree that PSI must and is hereby authorized to report and/or withhold your winnings in accordance with U.S. tax reporting and withholding laws as in effect from time-to-time. All winnings subject to reporting and/or withholding may be reported and/or withheld by PSI and a copy of the W-2G Form (or such other form provided by the U.S. Internal Revenue Service for this purpose) summarizing the information may be issued by PSI for tax purposes no later than when required by applicable law. In the event of any technical, system or human error resulting in insufficient withholdings from any winnings, we may deduct the relevant outstanding amount from funds in your Account or recover the relevant outstanding amount from you through any other lawful means. You hereby irrevocably authorize us to file all required reports regarding your wagering activities with the U.S. Internal Revenue Service and any other applicable taxing authority. In addition to any withholding by us, you may be subject to additional income withholding requirements based on the applicable law in your state of residency. You are solely responsible for any taxes incurred in connection with winnings on the Services.
You agree to indemnify and hold harmless PSI for any claims, demands, liens, or judgments based on your non-payment or underpayment of such taxes. You hereby grant to PSI a priority lien and security interest in all of your right, title and interest in and to the proceeds of any wager to the extent required to satisfy any taxing authority’s claims or liens.
